Lost someone because another person was careless?
Jacobson Injury Firm handles the claim so your family can handle everything else.
Nothing about a legal claim answers what happened to your family. What it can do is stop the loss from becoming a financial collapse on top of a personal one. Davie families face these claims after crashes where I-595, I-75, and the Florida Turnpike converge, after job site failures, and after treatment that went wrong. Our wrongful death lawyer in Davie, FL handles the filing, the insurers, and the court process. Call (561) 567-7163 for a free consultation.
Wrongful Death Lawyer in Davie, FL
Florida runs these claims through a specific statute with rules that surprise most families. One person files on behalf of everyone. Survivors are defined by statute rather than by who felt the loss most. Certain survivors recover categories of damages that others cannot.
Get the structure wrong and the claim stalls or the wrong people get left out. A Davie wrongful death attorney sorts out the personal representative, the survivor list, and the deadline before the insurer starts making offers.

Why Choose Jacobson Injury Firm for a Wrongful Death Claim
Handling That Does Not Add to the Burden
Families in this position are arranging a funeral, managing an estate, and absorbing a lost income at once. Adam Jacobson works with clients directly rather than passing them to a rotating case manager. He earned his Juris Doctor from Florida International University College of Law and is admitted to the bar in Florida, New York, Connecticut, and Illinois.
Results in the Most Serious Matters
Our firm has recovered millions of dollars for clients. These claims turn on projecting decades of lost support, and a settlement built on funeral costs and a few months of wages does not come close.
Nothing Owed Unless We Recover
Wrongful death claims in Davie, FL run on a contingency fee agreement, with case costs advanced by the firm.

Cases That Give Rise to a Wrongful Death Claim
- Traffic and highway crashes: The most common source, and the one where multiple policies most often exist.
- Commercial truck collisions: Weight disparity and a corporate defendant, which our [truck accident page] addresses.
- Motorcycle and pedestrian fatalities: Riders and people on foot have no protection at impact, and our [pedestrian accident page] covers the defenses insurers raise.
- Job site deaths: Workers’ compensation pays a death benefit, and a separate claim may run against a third party, which our [construction accident page] explains.
- Dangerous property: Drownings, fires, structural failures, and assaults on premises where security failed.
- Defective products: A vehicle component, a tool, or a consumer product that failed, supporting a [product liability] claim.
- Medical negligence: These carry their own procedures and a damages restriction covered below.
Who Files and Who Counts as a Survivor
The family does not file individually. Under Florida Statute § 768.20, the decedent’s personal representative brings the action and recovers for the benefit of the survivors and the estate. One claim, brought by one person, covering everyone.
Florida Statute § 768.18 defines who those survivors are: the spouse, children, parents, and any blood relatives who were partly or wholly dependent on the decedent for support or services. Two definitions inside that section carry real weight:
- “Minor children” means children under 25, regardless of the age of majority. A 23-year-old counts as a minor child for damages purposes, which surprises nearly everyone.
- “Support” includes contributions in kind as well as money, and “services” covers the household tasks the decedent regularly performed that now become an expense to the family.
That second definition matters more than families expect. A parent who ran the household, drove the children, and maintained the home was providing something the claim can value, whether or not they earned a paycheck.
You have two years to file under Florida Statute § 95.11, which sets the wrongful death period in subsection (5)(e). Our statute of limitations page covers the narrow exceptions.
What Survivors Can Recover
Florida Statute § 768.21 sorts recovery by who the survivor is.
- Every survivor may recover lost support and services from the date of injury through death, with interest, plus future loss of support and services.
- The surviving spouse may also recover for loss of companionship and protection, and for mental pain and suffering from the date of injury.
- Minor children, meaning those under 25, may also recover for lost parental companionship, instruction, and guidance, and for their own mental pain and suffering.
- Parents of a deceased minor child may also recover for mental pain and suffering from the date of injury.
- The estate may recover lost earnings, medical expenses, and funeral costs.
Establishing liability still requires proving negligence, and comparative fault under Florida Statute § 768.81 reduces recovery by the decedent’s share of blame. Punitive damages stay available under Florida Statute § 768.72 where conduct showed conscious disregard for safety. Preserved evidence decides most of it.
The Medical Malpractice Exception You Need to Know About
One restriction inside the act catches families completely unprepared, and it is still law.
Subsection (8) of section 768.21 bars adult children from recovering the companionship and mental pain damages listed above, and bars parents of an adult child from recovering their mental pain and suffering, where the claim is for medical negligence. Since the act treats anyone 25 or over as an adult child, the practical effect is stark: when an unmarried person 25 or older with no children under 25 dies because of medical negligence, no one in the family may recover noneconomic damages at all.
Repeal has come close twice and failed twice. The Legislature passed HB 6017 in 2025 and Governor DeSantis vetoed it on 29 May 2025, with no override attempted. The House passed HB 6003 by 88 votes to 17 in January 2026 and the Senate let it die. The restriction remains in force, so any page telling you otherwise is out of date. Economic damages survive it, and our [medical malpractice page] covers how those claims run.
Frequently Asked Questions
Who becomes the personal representative?
Whoever the will names, or someone the court appoints where there is no will. We help families through that appointment.
What if survivors disagree about the claim?
The personal representative brings one action for everyone, and allocation among survivors gets resolved as part of the resolution. Disagreement does not stop the case.
Does a criminal case have to finish first?
No. The civil claim proceeds on its own schedule and a lower burden of proof. A criminal conviction can help, and an acquittal does not end the civil claim.
How long does this take?
It depends on liability, the number of survivors, and available coverage. Our case timelines page walks through the stages.
